für Dienstleistungen im Bereich Space Concept und Experience Design

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen gelten für alle Angebote und Dienstleistungen im Bereich Interior Design, Raumkonzepte und Beratungen der anderswie LLC, gegenüber Privatpersonen und Unternehmen in Europa. Abweichende Bedingungen gelten nur, wenn sie schriftlich bestätigt wurden.

2. Leistungsbeschreibung

Die anderswie LLC erbringt kreative Dienstleistungen wie Innenraumberatung, Raumkonzepte, Moodboards, Materialvorschläge und stilistische Empfehlungen.
Der konkrete Leistungsumfang ergibt sich aus dem individuellen Angebot oder der Projektbeschreibung.

3. Kreative Leistungen – Haftungsfreistellung

Interior Design ist eine kreative, subjektive Dienstleistung. Kunden erkennen an:

  1. dass gestalterische Empfehlungen Geschmacksurteile sind und nicht objektiv bewertet werden können,
  2. dass endgültige Umsetzungen (Umbau, Möbelaufbau, Elektroarbeiten, Bauleistungen usw.) nicht von der anderswie LLC ausgeführt werden und ausschließlich in der Verantwortung der Kunden bzw. beauftragten Drittfirmen liegen,
  3. dass die anderswie LLC nicht für bauliche, technische oder statische Aspekte haftet,
  4. dass Farben, Stoffe, Materialien und Lichtsituationen je nach Umgebung abweichen können.

Die anderswie LLC übernimmt daher keine Haftung für Schäden, die durch die spätere Umsetzung des Konzepts entstehen.

4. Verantwortung der Kunden

Kunden stellen alle relevanten Informationen wie Maße, Fotos, Grundrisse oder besondere Anforderungen bereit.
Falsche oder unvollständige Angaben können das Ergebnis beeinflussen und liegen nicht in der Verantwortung der anderswie LLC.

5. Preise und Zahlung

Die Preise werden vor Beginn des Projekts kommuniziert.
Rechnungen sind sofort nach Erhalt ohne Abzüge zahlbar, sofern nichts anderes vereinbart wurde.
Unternehmen erhalten Rechnungen netto, Privatkunden brutto (falls erforderlich je nach Steuerregelung des Landes).

6. Nutzungsrechte

Alle Konzepte, Skizzen und kreativen Inhalte bleiben geistiges Eigentum der anderswie LLC.
Kunden erhalten ein einfaches Nutzungsrecht zur Umsetzung im eigenen Objekt.
Eine Weitergabe an Dritte oder gewerbliche Nutzung bedarf der schriftlichen Zustimmung.

7. Stornierung und Terminabsagen

Beratungstermine können bis 24 Stunden vorher kostenfrei verschoben oder abgesagt werden.
Bei kurzfristigeren Absagen oder Nichterscheinen kann eine Gebühr von bis zu 50 % des Honorars erhoben werden.

8. Haftung

Die Haftung der anderswie LLC ist auf Vorsatz und grobe Fahrlässigkeit beschränkt.
Für Folgeschäden, entgangenen Gewinn oder Umsetzungsfehler durch Dritte wird keine Haftung übernommen.
Dies gilt insbesondere für:

  • Handwerks- oder Bauleistungen
  • Lieferverzögerungen von Herstellern
  • Farb- oder Materialabweichungen
  • Montage- oder Installationsfehler

9. Datenschutz

Personenbezogene Daten werden ausschließlich zur Durchführung des Auftrags verarbeitet und nicht an Dritte weitergegeben, außer wenn dies zur Leistungserbringung notwendig ist.
Die Verarbeitung erfolgt im Einklang mit den geltenden europäischen Datenschutzbestimmungen.

10. Anwendbares Recht

Es gilt das Recht des Bundesstaates Wyoming, USA.
Für Verbraucher in Europa gelten darüber hinaus die zwingenden Verbraucherschutzvorschriften des jeweiligen Wohnsitzlandes.

1. Scope of Application

These Terms and Conditions apply to all offers and services provided by anderswie LLC in the fields of interior design, space concept development, and consulting, for both private clients and businesses within Europe. Deviating conditions are only valid if expressly confirmed in writing.

2. Description of Services

anderswie LLC provides creative services such as interior consulting, space concepts, moodboards, material recommendations, and stylistic guidance.
The exact scope of services is defined in the individual proposal or project description.

3. Creative Services – Liability Release

Interior design is a creative and subjective service. Clients acknowledge that:

  • design recommendations are matters of taste and cannot be evaluated objectively,
  • final implementations (renovation, furniture assembly, electrical work, construction work, etc.) are not performed by anderswie LLC and remain solely the responsibility of the client or any third-party contractors they engage,
  • anderswie LLC assumes no liability for structural, technical, or safety-related aspects,
  • colors, materials, fabrics, and lighting may appear different depending on the environment.

anderswie LLC is therefore not liable for any damages arising from the later implementation of the provided concept.

4. Client Responsibilities

Clients must provide all relevant information such as measurements, photos, floor plans, or special requirements.
Incorrect or incomplete information may affect the results and is not the responsibility of anderswie LLC.

5. Prices and Payment

Prices are communicated before the start of the project.
Invoices are payable in full upon receipt unless otherwise agreed.
Businesses receive net invoices, while private clients receive gross invoices, depending on applicable tax regulations in their country.

6. Usage Rights

All concepts, sketches, and creative materials remain the intellectual property of anderswie LLC.
Clients receive a simple usage right for implementing the concept in their own space.
Any transfer to third parties or commercial use requires written permission.

7. Cancellations and Appointment Changes

Consultation appointments can be rescheduled or cancelled free of charge up to 24 hours in advance.
For shorter cancellations or no-shows, a fee of up to 50% of the agreed service price may apply.

8. Liability

anderswie LLC’s liability is limited to intent and gross negligence.
No liability is assumed for consequential damages, loss of profit, or implementation errors caused by third parties.
This applies in particular to:

  • construction or craftsmanship work,
  • delivery delays from manufacturers,
  • variations in colors or materials,
  • assembly or installation issues.

9. Data Protection

Personal data is processed solely for the purpose of fulfilling the contract and is not shared with third parties unless required for service delivery.
Data processing is carried out in accordance with applicable European data protection laws.

10. Governing Law

The laws of the State of Wyoming, USA, apply.
For consumers within Europe, mandatory consumer protection regulations of their respective country of residence additionally apply.
